1. Agreement

These Terms are an agreement between you and Bits42 Internet Technologies Private Limited ("MailValid", "we", "us"), a company registered in India. They cover your use of the MailValid website, dashboard and API (the "Service").

By creating an account or using the Service, you agree to these Terms. If you're using MailValid for a company, you confirm that you're allowed to accept these Terms for that company. If you don't agree, please don't use the Service.

2. The Service

MailValid checks whether email addresses are valid and likely to receive email. You can check single addresses, upload lists, or use our API.

3. Your account

You must be at least 18 years old.
Give us accurate information, and keep your password and API keys safe.
You're responsible for everything done through your account and your API keys.
Tell us straight away at sachin@mailvalid.io if you think someone else is using your account.

4. Credits

How credits work: one credit is used for each completed verification.
- Catch-all results cost 1 credit, like any other completed result.
- Unknown results, where we can't reach any result, are free.
- Duplicate addresses in the same upload are free.
Free credits: new accounts get 100 free credits. We may sometimes add bonus credits; these have no cash value.
Credits never expire. This applies to all credits: Pay As You Go, Top-up, monthly plan and free credits. Unused monthly plan credits carry over from month to month, and stay in your account if your plan ends.

5. Plans, packs and billing

Monthly plans

MailValid Plus is a monthly plan that renews automatically. Your payment method is charged the plan price on each renewal date until you cancel. Customers on older plans, such as Starter, keep their plan on the same terms.
Upgrading to a bigger plan takes effect immediately. The new plan's credits are added straight away, and you're charged the full new price today.
Switching to a smaller plan takes effect on your next renewal date. Your current plan, and its credits, continue until then. The new plan's credits are added on the renewal date, not right away.
Cancelling: go to Dashboard → Plan & billing and click Cancel subscription. Cancellation takes effect at the end of your current billing period. You keep any credits already added, and you won't be charged again.

One-time packs

Top-up packs are for monthly plan customers who need extra credits straight away. The credits are added immediately, your plan stays exactly as it is, and the pack never renews.
Pay As You Go packs are for customers who don't want a monthly plan. The credits are added immediately and the pack never renews. If you're on a monthly plan, buying a Pay As You Go pack cancels your monthly plan straight away. You keep all credits already in your account, but the rest of your current billing period isn't refunded. To keep your plan, buy a Top-up pack instead.

Payment and prices

Payments are processed by DodoPayments, and their terms also apply to your purchase.
Prices don't include taxes. Applicable taxes are added at checkout. We may change prices, but we'll tell you at least 30 days before a change affects your plan.

6. Refunds

Purchases are generally non-refundable, but we do refund in some cases, such as duplicate charges, billing errors, unauthorised charges and long outages. Our Refund and Cancellation Policy explains when and how to ask for a refund.

7. Acceptable use

You agree not to:

use the Service to send spam, or to break anti-spam or privacy laws (for example CAN-SPAM, GDPR, CASL or India's DPDP Act)
check email addresses you have no lawful reason to contact
resell or share access to the Service without our written permission
try to copy, reverse-engineer or break into the Service
get around rate limits or overload our systems
use the Service for anything illegal, harmful or fraudulent

We may suspend accounts that break these rules.

8. API use

Your API keys are your responsibility. Rate limits apply as described in our documentation. We may limit or suspend API access in cases of abuse or unusually heavy use that affects other users.

9. Your data

The lists and email addresses you verify belong to you.

We store your uploaded lists, single checks and their results so you can see your history and download your results again.
We use them only to provide the Service. We never sell them, share them or use them for marketing.
You can ask us to delete them at any time.

10. Verification results

Our results are our best assessment at the moment of the check. Email systems change, and some mail servers hide whether an address exists. We can't guarantee that an email will be delivered, or that every result will be correct. We aren't responsible for bounces, spam complaints, blocklisting or damage to your sender reputation. You decide how to use the results.

If you believe a large batch returned wrong results, our Refund and Cancellation Policy explains how to ask us to review it.

11. Availability

We aim for 99.9% uptime, but we can't promise the Service will always be available or error-free. The Service is provided "as is", without warranties of any kind. We may change or discontinue features. If we discontinue the Service entirely, we'll give you at least 30 days' notice.

12. Limitation of liability

As far as the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost data or lost business. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

13. Indemnity

You agree to cover any claims, losses or costs we face because of how you used the Service, because you broke these Terms, or because you broke the law.

14. Closing your account

You can close your account at any time by emailing sachin@mailvalid.io.
We may suspend or close your account if you break these Terms. Where reasonable, we'll warn you first.
When an account is closed, unused credits aren't refunded, except as described in our Refund and Cancellation Policy or where the law requires it.

15. Changes to these Terms

If we make important changes, we'll tell you by email or in your dashboard at least 30 days before they take effect. If you keep using the Service after that, you accept the new Terms.

16. Governing law

These Terms are governed by the laws of India. Any dispute will be handled by the courts in Latur, India.
