1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Bits42 Internet Technologies Private Limited ("Company," "we," "us," "our"), a company incorporated under the laws of India, governing your access to and use of the Mailvalid email verification platform and API services ("Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Mailvalid provides an email verification API that allows users to validate email addresses for deliverability. The Service includes single email verification, bulk email verification, and related features accessible via our REST API and web dashboard.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

You must be at least 18 years old to create an account and use the Service.

4. Credits and Payment

The Service operates on a credit-based system. Key terms:

Credits: Each email verification consumes 1 credit. New accounts receive 100 free credits.
Pricing: Credit packages are available at published rates. Prices may change with notice.
Expiration: Purchased credits never expire unless stated otherwise at time of purchase.
Payment: All payments are processed through DodoPayments. By purchasing, you agree to their terms of service.
Taxes: Prices are exclusive of applicable taxes, which will be added at checkout.

5. Acceptable Use

You agree NOT to use the Service to:

Verify email addresses obtained without consent (spam, scraping, purchased lists)
Violate any applicable laws, including anti-spam regulations (CAN-SPAM, GDPR, etc.)
Resell, sublicense, or redistribute access to the Service without written permission
Attempt to reverse-engineer, decompile, or extract the Service's underlying technology
Exceed rate limits or attempt to disrupt the Service's infrastructure
Use the Service for any illegal, harmful, or fraudulent purpose

6. API Usage

Access to the API is provided via API keys. You are responsible for all API calls made with your keys. Rate limits apply as documented. We reserve the right to suspend API access for abuse or excessive usage.

7. Data and Privacy

We process email addresses solely for verification purposes. We do not store, sell, or share verified email addresses. For details, see our Privacy Policy.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind. We may modify, suspend, or discontinue the Service at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, Bits42 Internet Technologies Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid for credits in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Bits42 Internet Technologies Private Limited from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by contacting support. Upon termination, unused credits are non-refundable except as required by law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or dashboard notification at least 30 days before taking effect. Continued use of the Service constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
